One year of the Legal Clinic "Maria Luisa Marin"

Un año de actividades de la Clínica Jurídica sobre Derecho a la Vivienda “María Luisa Marín”

En reportes anteriores hemos compartido los principales avances de la Clínica Jurídica sobre Derecho a la Vivienda “María Luisa Marín”, y en el pasado enero, a un año del inicio de sus actividades, se ha realizado un ejercicio de evaluación importante, además de establecerse la línea de acción para el 2024. En el balance de actividades realizado se relata que desde el 2023 hasta los primeros meses de 2024 se brindaron 12 asesorías gratuitas a personas y grupos vulnerables, entre ellos solicitantes de asilo, para dar orientación en materia de desalojos, fraude, arrendamientos, vivienda de personas de la tercera edad, entre otros.

De igual forma, el año pasado se contó con la inscripción de 19 estudiantes de derecho de la Universidad Iberoamericana a las clases impartidas por la Clínica, quienes además se incorporaron a las estrategias de investigación, análisis y asesoría de ésta.En los primeros meses del año ya se cuenta con la inscripción de 3 nuevos estudiantes en las sesiones de formación, así como con la participación de 4 estudiantes de servicio social de semestres más avanzados de la carrera de derecho.

En el plan de acción para el 2024 se plantea dar seguimiento a algunas de las asesorías y atender nuevas; continuar avanzando en el análisis sobre el marco jurídico de desalojos en México y las obligaciones del Estado en la materia; producir materiales de difusión; contar con un folleto explicativo de la clínica para que más personas se acerquen a ella; y fortalecer alianzas con clínicas de otros países. 

HIC-AL, además de dar apoyo a la clínica, ha seguido litigando  el caso del desalojo de una mujer adulta mayor con serios problemas de salud que se ha compartido a través de informes previos. En marzo presentamos un recurso de apelación ante la sentencia emitida por un juez para desalojarla empleando la legislación nacional e internacional sobre el tema.

One year of the Legal Clinic on Housing Rights "María Luisa Marín"

In previous reports we shared the main achievements of the Legal Clinic "María Luisa Marín", and last January, one year after the beginning of its activities, an important internal evaluation was conducted as well as the establishment of the 2024 activities plan. In the assessment of activities carried out, it is reported that from 2023 to the first months of 2024, 12 free legal counseling services were provided to vulnerable individuals and groups, including asylum seekers, to offer guidance on evictions, fraud, leases and housing for the elderly, among others. 

In addition, last year 19 law students from the Universidad Iberoamericana took the classes taught by the Clinic and also joined the Clinic's research, analysis and counseling strategies. In the first months of 2024, 3 new students have already enrolled in the training sessions, and we have 4 students on an internship from more advanced semesters of the law program at the university participating in the Clinic.

Our plan for 2024 is to follow up on some of the cases for which we have offered advice, as well as provide new ones; continue the analysis of the legal framework for evictions in Mexico and the State's obligations in this area; prepare dissemination materials; create a brochure with information of the Clinic and the services it provides so that more people can approach it; and strengthen alliances with clinics in other countries. 

Furthermore, HIC-AL has continued the legal proceedings, as it has been shared in previous reports, in the case of eviction of an elderly woman suffering from serious health conditions. In March, we filed an appeal against the sentence dictated by a judge to evict her, where we addressed national and international legislation on the subject to provide arguments against the violation of her rights.
