¨Request for differential treatment for refugee and migrant women in a state of vulnerability¨
Meeting of community-based organizations before the Ombudsman
Gender violence constitutes one of the most serious violations of human rights, which especially affects the right to comprehensive health and personal development, and in extreme cases the right to life itself.
Migrant status can accentuate the vulnerability and exposure of women to situations of gender violence. The scarce social or family support network, a cultural context different from their own in which they suffer discrimination, added to structural inequalities, based on gender, class, age, ethnic, national and linguistic patterns, converge in a greater violation of their rights and have greater difficulties in accessing public services for the assistance and prevention of gender violence. Thus, the challenge is configured that the actions aimed at eradicating violence and promoting the effective fulfillment of women's rights include the migratory particularity in their approach.
In Peru, Law No. 30364 establishes that its purpose is to “prevent, eradicate and punish all forms of violence produced in the public or private sphere against women due to their status as such, and against members of the family group; especially when they are in a vulnerable situation, due to their age or physical situation, such as girls, boys, adolescents, older adults and people with disabilities”.
We understand by "people in a condition of vulnerability" the following: They are people who, due to their age, gender, physical or mental state, ethnic origin or due to social, economic, cultural or linguistic circumstances, encounter special difficulties in exercising fully their rights. This includes, but is not limited to, belonging to peasant communities, natives and indigenous or native peoples, the Afro-Peruvian population, migration, refuge, displacement, poverty, gender identity, sexual orientation, deprivation of liberty, the state of pregnancy, disability, among others.
Within the framework of the celebration for Women's Day, we assisted as a Venezuelan community-based organization in Peru to request before the Ombudsman in the presence of the Minister of the Ministry of Women and Vulnerable Populations (MIMP) Nancy Tolentino Gamarra, and other important authorities of the Peruvian government to request differential treatment for refugee and migrant women in a state of vulnerability, as established in article 8.4 of Law 30364.
We continue to raise our voices for women in vulnerable situations, we fight for refugee women, migrants and the host population with the firm purpose of eradicating GBV.
